Terms & Conditions — NetPulse
These Terms and Conditions (“Terms”) govern your access to and use of the NetPulse mobile application (the “App”, Android package com.tcs.network.speedtest) provided by TriCode Studio (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved by TriCode Studio.
2. The Service
NetPulse provides tools to view network and connection information, run internet speed tests (download, upload, ping, and jitter), and monitor mobile and Wi-Fi data usage on your device.
3. Measurement Accuracy Disclaimer
Speed-test results, signal readings, data-usage figures, and other measurements shown in the App are estimates only. They may vary based on your device, operating system, network conditions, server load, the third-party test servers used, and other factors outside our control. The App is provided for general informational purposes and should not be relied upon for billing disputes, professional, legal, or safety-critical decisions.
4. Acceptable Use
You agree not to:
- use the App for any unlawful or fraudulent purpose;
- reverse engineer, decompile, or disassemble the App, except to the extent permitted by law;
- interfere with, disrupt, or overload the App or the servers and networks it connects to;
- attempt to gain unauthorized access to any part of the App or related systems; or
- use the App in a way that infringes the rights of others.
5. Third-Party Services and Advertising
The App relies on third-party services — including Cloudflare speed-test servers, IP-lookup services, Google AdMob, and Google Firebase — and may display advertisements. We do not control and are not responsible for third-party services, advertisements, or the content they provide, and your interaction with them may be subject to their own terms and policies. Standard carrier data charges may apply when you use the App, particularly when running speed tests.
6. Intellectual Property
The App, including its design, source code, graphics, logos, and the “NetPulse” and “TriCode Studio” names, is owned by TriCode Studio and protected by applicable intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how information is handled. By using the App, you consent to those practices.
8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that measurements will be accurate.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRICODE STUDIO AND ITS OWNERS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. To the extent liability cannot be excluded, our total aggregate liability shall not exceed the amount you paid for the App, which, if the App is free, is zero.
10. Indemnification
You agree to indemnify and hold harmless TriCode Studio from and against any claims, damages, liabilities, and expenses arising out of your misuse of the App or your violation of these Terms.
11. Updates and Availability
We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice. We are not liable to you or any third party for doing so.
12. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, the license granted to you ends and you must stop using and delete the App.
13. Changes to These Terms
We may revise these Terms from time to time. The updated Terms will be posted on this page with a new “Last updated” date. Your continued use of the App after changes take effect means you accept the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of [Country / State — insert your jurisdiction], without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes.
