1. Agreement to these Terms
These Terms and Conditions (“Terms”) are a legal agreement between you and TriCode Studio (“we”, “us”, “our”) governing your use of the Math Explorer mobile application (“the App”).
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App and uninstall it from your device.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
2. Who may use the App
Math Explorer is an educational game designed for children learning arithmetic.
- If you are under 18, you may use the App only with the permission and supervision of a parent or legal guardian.
- If you are a parent or guardian, you accept these Terms on behalf of any child you allow to use the App, and you are responsible for their use of it.
- If you are an educator or institution using the App with students, you confirm you have authority to accept these Terms for that use.
The App requires no account, no registration, and no personal information to function.
3. Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial, educational purposes.
You may not:
- copy, modify, translate, or create derivative works of the App;
- reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this limitation;
- rent, lease, lend, sell, sublicense, or otherwise distribute the App;
- remove, obscure, or alter any copyright, trademark, or other proprietary notices;
- use the App in any way that interferes with its normal operation, or that attempts to bypass the parental gate, the ad delivery, or any security measure;
- use automated tools, emulators, or modified builds to generate fraudulent ad impressions or clicks;
- use the App for any unlawful purpose or in violation of any applicable law or regulation.
We reserve all rights not expressly granted to you.
4. What the App does
Math Explorer offers four learning levels — Addition, Subtraction, Multiplication, and Division — each with progressively harder sub-levels of ten questions. It includes a countdown timer per question, a hint system, sound feedback generated on the device, high-score tracking, and recent-session progress.
Game content, difficulty scaling, sounds, visuals, and features may change, be added, or be removed in future versions at our discretion.
The App is a practice and reinforcement tool. It is not a substitute for a curriculum, a classroom, a tutor, or professional educational assessment. We make no promise about any particular learning outcome, exam result, or improvement in ability.
5. Parental gate
Settings and any action that would take a user outside the game are placed behind a parental gate — a math question intended to be answered by an adult. The parental gate is a reasonable protective measure, not a guarantee. Parents and guardians remain responsible for supervising their child’s device use, including advertisements and any external content reached through them.
6. Advertising
The App is free and is supported by advertisements delivered through Google AdMob.
- Ads shown in the App are non-personalized and tagged for child-directed treatment, as described in the Privacy Policy.
- We do not create, select, endorse, or control the specific advertisements that appear. Advertisers and ad networks are responsible for their own content.
- Tapping an ad may open a third-party website or app store listing. Any transaction, download, or interaction that follows is between you and that third party, on their terms, and we are not a party to it and accept no responsibility for it.
- Deliberately generating invalid ad impressions or clicks — manually, or with scripts, bots, or modified builds — is prohibited and may result in termination of your licence.
If you encounter an advertisement that appears inappropriate for children, please report it to us at support@tricodestudio.com with a screenshot and the approximate time, and we will report it to the ad network.
7. In-app purchases and virtual items
The App currently contains no in-app purchases and no subscriptions. All features are available at no cost.
Scores, high scores, sub-level progress, and any other in-game progress have no monetary value, cannot be exchanged for money or goods, and are not your property. They are stored locally on your device only. We are not obliged to restore, transfer, or compensate for progress that is lost — for example after uninstalling the App, clearing app data, resetting or losing the device, or a software fault.
If in-app purchases are introduced in a future version, they will be handled by Google Play, will be governed by the terms in effect at that time, and will be placed behind a parental gate where required by the Google Play Families policy.
8. Third-party services
The App integrates the following third-party services, and your use of the App is subject to their terms in addition to ours:
- Google AdMob — advertising. policies.google.com/terms
- Firebase Crashlytics — crash and stability reporting. firebase.google.com/terms
- Firebase / Google Analytics for Firebase — aggregate usage statistics. firebase.google.com/terms
- Google Play — distribution of the App. play.google.com/about/play-terms
We are not responsible for the availability, accuracy, content, or practices of these third-party services.
9. Internet connection and device costs
Core gameplay works offline. An internet connection is required to load advertisements and to send crash and analytics reports. You are responsible for any mobile data charges, roaming charges, or other costs your carrier or internet provider imposes as a result of using the App, and for making sure that using the App does not breach your mobile plan.
You are also responsible for keeping your device secure and for ensuring your device meets the App’s minimum requirements (Android 7.0 / API 24 or higher).
10. Intellectual property
The App and everything in it — including its source code, design, layouts, colour themes, artwork, backgrounds, mascot, generated sounds, question-generation logic, text, and the name “Math Explorer” — is owned by TriCode Studio and is protected by copyright and other intellectual property laws.
Nothing in these Terms transfers any ownership to you. Third-party trademarks referenced in the App or in these documents (such as Google, Android, AdMob, and Firebase) belong to their respective owners and are used for identification only.
11. Updates and availability
We may release updates, patches, or new versions of the App, and Google Play may install them automatically depending on your device settings. We may also change, suspend, or discontinue the App, or any of its features, at any time and without prior notice.
We do not guarantee that the App will be available without interruption, that it will be free of errors, or that it will remain compatible with every device, Android version, or future operating system release.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will meet your requirements, that its operation will be uninterrupted or error-free, that defects will be corrected, or that the mathematical content, hints, or scoring are free of mistakes.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits consumer rights that cannot be waived under the law that applies to you.
13. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of progress, loss of profits, or loss of goodwill, arising out of or connected with your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the App and these Terms is limited to the greater of (a) the amount you actually paid us for the App in the twelve months before the claim, which for a free app is zero, or (b) USD 25.00.
Nothing in this section excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
14. Indemnity
You agree to indemnify and hold harmless TriCode Studio from any claim, demand, loss, or expense (including reasonable legal fees) arising from your misuse of the App, your breach of these Terms, or your violation of any law or third-party right. This does not apply to the extent the claim arises from our own breach or negligence, and it does not apply to a child user acting without an adult’s involvement.
15. Termination
These Terms remain in effect while you use the App. You may terminate them at any time by uninstalling the App.
We may suspend or terminate your licence immediately, without notice, if you breach these Terms — in particular the restrictions in Sections 3 and 6. On termination, you must stop using the App and delete it from your devices. Sections 10 through 14 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of [Country / State — insert your jurisdiction], without regard to its conflict-of-law rules. You and we agree to submit to the exclusive jurisdiction of the courts of that jurisdiction to resolve any dispute arising out of these Terms.
If you are a consumer resident in the EU, EEA, UK, or another jurisdiction with mandatory consumer protection rules, you keep the benefit of the protections and the right to bring proceedings in the courts of the country where you live.
We encourage you to contact us first at support@tricodestudio.com — most issues can be resolved informally.
17. General
- Severability — if any provision of these Terms is found unenforceable, the remaining provisions stay in full force.
- No waiver — our failure to enforce a right is not a waiver of that right.
- Entire agreement — these Terms and the Privacy Policy are the entire agreement between you and us about the App, replacing any earlier understandings.
- Assignment — you may not assign these Terms. We may assign them to a successor as part of a merger, acquisition, or sale of assets.
- Apple / Google — Google Play is a distributor only, is not a party to these Terms, and has no obligation to provide support or maintenance for the App.
18. Changes to these Terms
We may revise these Terms from time to time. The updated version will be posted at the same location with a new “Last updated” date, and material changes will be noted in the app store release notes. Continuing to use the App after changes take effect means you accept the revised Terms. If you do not accept them, please uninstall the App.
